Update on developing e-compliance in ICC rules: Minimum Standards

As mentioned in a recent blog, the e-Rules Drafting Group commenced a fresh re-drafting process of eUCP & eURC, culminating in a 3rd draft of the rules being sent to ICC National Committees in July 2018, with a deadline of 28 September 2018 to respond. 

 

A document providing a response to each individual comment from ICC National Committees accompanied the new drafts.

 

In addition, during the drafting of the e-rules, it became apparent that it would be essential to provide guidance to practitioners by identifying and documenting minimum standards surrounding certain practices, as detailed below:

 

  • FORMAT
  • Identify the minimum recommended format standards for electronic records.
  • ELECTRONIC ADDRESS
  • Identify the minimum recommended standards for an electronic address.
  • AUTHENTICATION
  • Identify, from a practice perspective, the minimum recommended standards for authentication.
  • ELECTRONIC SIGNATURE
  • Identify, from a practice perspective, the minimum recommended standards for electronic signatures.
  • COMMERCIALLY ACCEPTABLE DATA PROCESSING SYSTEM
  • Identify, from a practice perspective, the minimum recommended standards for a commercially acceptable data processing system.

 

Practices need standards but it is not within the rules that practices should be documented.

 

It is intended that the documenting of minimum standards will be completed prior to the release of the revised rules.
